BPCC Academy: LAW IN PRACTICE – Subcontracting in public contracts
BPCC together with Anna Szymańska and Michał Drozdowicz of the Dentons Public Procurement practice have the pleasure of inviting you to a seminar on subcontracting in public contracts, during which they will discuss a selection of practical issues worth considering in the run-up to the expected new wave of public projects.
The workshops will be held in Polish
Subcontracting will be explored by separately looking at the tendering stage and the public contract performance stage.
The topics relevant to the tendering stage which we intend to discuss include:
- the subcontractors’ potential as a factor contributing to success in the rivalry for public contracts
- rules of resource utilization
- third-party liability risksp
For the public contract performance stage, we will explore:
- issues relating to civil law contracts and the protection of subcontractors on the grounds of public procurement law
- possibilities of replacing or letting go subcontractors contributing their resources to the contractor’s potential

Anna Szymańska
Counsel
Anna Szymańska is a member of the Warsaw Public Procurement Practice Team specializing in public procurement law and PPP commercial and civil law, including contracts law.She is highly experienced in representing bidders as well as awarding entities in the course of public procurement proceedings and in dealings before the National Chamber of Appeals and courts. Among others, Anna has focused on infrastructure, energy, construction, railways, waste treatment, transportation, financial services, defense & security, revitalization and telecommunications projects. Anna is a lecturer in Postgraduate Studies in Public Procurement at Warsaw University. She has participated in a parliamentary subcommittee on the economy advising on amendment s to the Public Procurement Act.
Michał Drozdowicz
Counsel
Michał Drozdowicz is a counsel in Dentons’ Warsaw office and a member of the public procurement practice team.Michał specializes in public procurement law, EU law and commercial contract law. He is highly experienced in representing clients, in particular from the infrastructure and energy sectors, in litigation matters before courts and the National Chamber of Appeals.Michał is listed in Who’s Who Legal international legal rankings as a specialist in the area of Public Procurement and Government Contracts in Poland. Michał has authored articles in the field of public procurement for leading Polish legal and business dailies such as Rzeczpospolita, Dziennik Gazeta Prawna (Polish quality daily) and others.
